Where a tenant with the previous consent in writing of the landlord effects improvements on the premises and the landlord determines the tenancy before the expiration of the tenancy, such tenant shall be entitled to claim compensation for the effected improvements on quitting the premises (Rent Control & Recovery of Premises Law, Lagos State)
Similarly, where a building is erected or further development is made on a property already mortgaged to a bank, during the tenor of the mortgage, that building or further development still forms part of the mortgaged property. This is based on a legal principle, quid quid plantutur solo solo cedit. The implication of this principle is that he who owns a land also owns what is on that land.
